1. Overview & Acceptance of Terms

This storefront is operated by Kapda Studio. Throughout the site, the terms “we”, “us” and “our” refer to Kapda Studio. By visiting our site and/or purchasing a product from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms, conditions, and policies referenced herein or available by hyperlink.

2. International Pricing, Currency, & Payment Authorization

  • Currency Conversion: Prices displayed on our storefront may be converted into your local currency (USD, GBP, AUD) for convenience. Final checkouts are processed in the currency specified at checkout. Kapda Studio is not liable for fluctuations in currency exchange rates or cross-border transaction fees levied by your credit card issuer or banking institution.

  • Payment Accuracy: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. We reserve the right to refuse or cancel any order if unauthorized or fraudulent transaction activity is suspected.

3. International Shipping, Customs, & Import Duties

  • DDU (Delivered Duty Unpaid): All international shipments are dispatched via third-party logistics partners (such as ShipGlobal) on a Delivered Duty Unpaid basis.

  • Customs Liability: The buyer is the importer of record and must comply with all laws and regulations of the destination country. Prices listed on our storefront are completely exclusive of local import duties, customs tariffs, value-added taxes (VAT), or courier clearance fees.

  • Fee Collection: Any such additional charges must be borne entirely by the buyer at the border. Kapda Studio maintains zero visibility or control over foreign customs policies and accepts no financial liability for delayed clearances or assessed tariffs.

4. Shipping Delays, Transit Risk, & Force Majeure

  • Carrier Liability: Once a package is transferred to our international shipping carrier and an Air Waybill (AWB) tracking number is generated, legal title and risk of loss pass completely to the buyer.

  • Force Majeure: Kapda Studio is not responsible for international transit delays caused by customs hold-ups, severe weather conditions, labor strikes, global supply chain bottlenecks, or force majeure events. We will assist in tracking packages but cannot issue refunds for transit delays outside our direct operational control.

5. Product Representation & Handcrafted Variations

  • Artisanal Variance: Every product listed is a unique, handcrafted, and hand-quilted item utilizing traditional print techniques.

  • Acceptable Variations: Due to the artisanal nature of the manufacturing process, minor variations in block print alignment, textile pattern repeats, stitch tension, and color saturation are inherent characteristics of the craftsmanship and are not considered manufacturing defects or damages.

6. Intellectual Property

All content included on this site, such as textile designs, pattern artwork, product photography, logos, symbols, marketing banners, and text, is the exclusive intellectual property of Kapda Studio and is protected by international copyright, trademark, and intellectual property laws. Any unauthorized reproduction or commercial distribution of our designs or assets is strictly prohibited and subject to immediate legal action.

7. Limitation of Liability & Indemnification

In no case shall Kapda Studio, our directors, officers, or employees be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind arising from your use of any of our products or services. You agree to indemnify, defend, and hold harmless Kapda Studio from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service.

8. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India, with exclusive legal jurisdiction resting in the courts of Jaipur, Rajasthan, India.
